Gestational surrogacy helps those who are unable to have children become parents through assisted reproduction with the help of an egg donor and gestational carrier. It’s a process that requires medical and legal expertise, as well as a strong support process throughout the journey.

Through IVF, embryos are created in a lab at a fertility clinic, using the gay intended parents' biology (one or both) as well as an egg donor. At the fertility clinic, 1-2 embryos are implanted into a gestational carrier, who carries the baby(ies) to term.

A gestational carrier has no genetic relationship to the child or children they deliver.

Beginning your journey toward gay surrogacy is a big step, so it's important to do your research! Not every surrogacy agency is a good fit, finding a surrogacy agency with which you have good chemistry and who shares your views about your the surrogacy process is key to a successful journey. Also, surrogacy laws vary by state, so working with an agency who has lawyers knowledgeable in ART and surrogacy law is important.

Growing your family through surrogacy means bringing two very important women into your life: your surrogate mother and your egg donor. You may have a family member or friend who wants to act as your egg donor, or perhaps you'll find an egg donor in our egg donor database.

Pregnancy and parenthood.

Hooray, your surrogate is pregnant and you're getting ready to become a dad! You'll be further developing your relationship with your surrogate, and perhaps even visiting her for appointments. Your agency will be supporting you through each milestone, helping you prepare for traveling for the birth and ensuring you have everything you need to return home safely and securely.

How do I begin the process?

Starting your surrogacy begins with a free consultation. You'll hear from an experienced attorney as well as a process consultant. We'll tell you about our surrogacy services, ask you about your experience so far, and answer any questions you have.

Can I be a parent if I or my partner is HIV+?
Yes. Thanks to the Special Program of Assisted Reproduction (SPAR), intended parents who are HIV+ are able to grow their families with surrogacy. Through a sperm washing technique and HIV testing, it is possible for HIV+ men to safely father a biological child of their own with no risk to the baby or surrogate. Yes. We are members of the American Society of Reproductive Medicine (ASRM). We work closely with the LGBT Community Center in New York, Family Equality Council, Resolve New England, Gay and Lesbian Advocates and Defenders (GLAD), and Parent via Egg Donation (PVED). Our attorneys are active in the American Bar Association (ABA) Section of Family Law’s Subcommittee on Assisted Reproduction Technology and are admitted to the Massachusetts, New York, and California State Bars. In other words, we’re firmly committed to protecting the rights of the LGBTQ community, and ensuring that everyone - regardless of sexual orientation - can build the family they dream of.
