An Overview of Surrogacy in Louisiana

Surrogacy in Louisiana is a highly regulated process for both intended parents and surrogates. It is limited to intended parents who are married and who are both biological parents of a child carried by a surrogate who isn’t compensated other than for limited expenses (this is called altruistic surrogacy). Because of this, Circle does not work with surrogates from the state of Louisiana because all of Circle’s surrogates are compensated. Circle Surrogacy does match intended parents with compensated gestational carriers who reside in other states.

Intended parents in Louisiana we work with may be:

• Heterosexual, married couples who have struggled with infertility
• Intended mothers who are unable to carry a child
• Intended parents who have a genetic defect or health condition they don't want to pass onto the child
• LGBTQ+ intended parents who want to have a genetic link to their baby

If you live in Louisiana and want to pursue surrogacy, this page is an excellent resource to learn more about what the surrogacy process involves, how to become a parent or surrogate mother, and what surrogacy costs.

The Surrogacy Process in Louisiana

As mentioned, the surrogacy process is more complicated in Louisiana than in most other states. That’s why it’s important to partner with an experienced surrogacy agency such as Circle Surrogacy. A surrogacy journey involves several milestones for both intended parents and the surrogate mother leading up to delivery day.

Choosing to pursue surrogacy independently—without the assistance of a surrogacy agency—is also an option available to anyone. That means you hire your own lawyer and coordinate with potential surrogates on your own.

Choosing an Agency
Researching your options is an important first step if you decide to work with a surrogacy agency. Besides looking into how long the agency has been involved in the surrogacy field, you’ll want to choose one in which you sense good chemistry and similar viewpoints about the surrogacy process. It’s essential that the agency works with a legal team whose lawyers have expertise in ART (Assisted Reproductive Technology) and surrogacy law, especially in a state such as Louisiana.
Finding a Surrogate and Egg Donor
Searching for a perfect surrogate match typically begins as soon as intended parents sign on with the agency. If intended parents require an egg donor, they may first match with an egg donor or the surrogate and egg donor matching can happen concurrently. Matching with a donor is accomplished by using our egg donor database. Our Matching Team helps intended parents navigate the database, which includes details about bright and ambitious young women who are excited about the opportunity to help you grow your family.
Pregnancy and Parenthood
Even though you’re matching with a gestational carrier outside of Louisiana, it’s still possible and encouraged to develop a close relationship with your surrogate during the pregnancy. You may even be able to plan for visits during certain appointments. Our agency supports you through each milestone and helps you prepare to travel for the birth, ensuring you have everything you need to return home safely.

You’ll likely know if the agency team is a good fit for your journey by the end of the meeting.

Circle Surrogacy offers complimentary consultations for intended parents who are emotionally and financially ready to begin a surrogacy journey within the next 12 months. Finding a Surrogate Mother

Finding a Surrogate Mother

One of the most exciting milestones in your journey is matching with a surrogate mother. Circle Surrogacy works with gestational surrogates from throughout the U.S., including states surrounding Louisiana.

Get Started

You may have already started thinking about the traits you consider important in a gestational carrier. That’s great! It’s important whether you’re working with an agency or pursuing an independent journey. It's also essential to know what you're looking for to determine if your surrogacy agency has presented you with a good match.

Circle Surrogacy asks intended parents to fill out a profile that helps us get to know them better and find appropriate surrogate matches.

The information we ask for in the profile includes your:

  • Relationship (if you have a partner)
  • Family
  • Hobbies and activities
  • Plans for parenthood
  • Reasons for pursuing surrogacy

We also can get a good sense of who you are as people through photos of yourself and your loved ones, along with anything else that communicates information to help us find the best possible surrogate matches.

It's important to be honest when thinking about how you answer these questions. Your Circle Program Coordination Team uses your answers—as well as your geographic location and views on termination— to find you the best possible surrogate match.

We also use other preferences to match you with your gestational carrier, including:

  • Desired level of communication with your surrogate during the journey
  • Location of the surrogate mother
  • Number of embryos to transfer
  • Views on selective reduction and termination

These criteria can serve as guidelines for what you consider a suitable match if you pursue surrogacy without an agency's assistance.

3 Criteria for Finding Surrogate Mothers

3 Criteria for Finding Surrogate Mothers

Keep these 3 factors in mind as you search for a surrogate mother:

Appropriate legal fit: We ensure potential gestational carriers meet both general and state-specific legal criteria before presenting surrogate profiles to intended parents.

Personality fit and surrogacy expectations: We want both surrogates and intended parents to have a comfortable relationship throughout the journey, so your Matching team reviews the list of safe matches provided by the legal team to ensure a good personality fit.

Expectations surrounding termination and selective reduction: Sharing similar views about the termination of a pregnancy (in situations in which a reduction or termination is considered) is essential for surrogates and intended parents. In our experience, intended parents often prefer to make the choice regarding termination.

 Search egg donor database

Finding an Egg Donor

Many intended parents use eggs donated by a fertile woman who wants to help another individual or couple conceive a child (with or without the help of a surrogate). An egg donor may be the intended parent herself or a surrogate for heterosexual or homosexual couples or individuals. Intended parents who have concerns about infertility can opt to build their families through egg donation. If you choose to use an altruistic (uncompensated) surrogate mother in Louisiana, the state’s surrogacy law requires that the couple donate their own eggs and semen to create an embryo.

Intended parents using a gestation carrier in another state can find an egg donor with Circle Surrogacy’s help. We guide you through the entire egg donation process and help you coordinate with an IVF clinic of your choice. The first place most intended parents start their egg donor search is in an egg donor database. Most egg donor databases are set up so you can search for an egg donor by certain criteria. Circle's egg donor database is easy to use and easy to navigate.

 Surrogacy Laws in Louisiana

Surrogacy Laws in Louisiana

The Louisiana Gestational Carrier Act was signed into law in 2016, specifically forbidding intended parents from compensating a surrogate mother who lives in Louisiana other than reimbursing the surrogate for actual expenses. Contracts between intended parents and Louisiana surrogates that include compensation beyond expenses are considered void and can’t be enforced. Surrogacy is legal in Louisiana only in limited circumstances, and the process can be challenging. Louisiana’s surrogacy law upholds gestational carrier agreements only when signed by intended parents who are a married, heterosexual couple who have both contributed their own gametes to create their embryo. Traditional surrogacy arrangements are also unenforceable and void.

Due to this law, intended parents cannot match with a woman acting as a surrogate if she lives in Louisiana. Instead, intended parents who live in Louisiana would simply match with a surrogate who lives in a surrogacy-friendly state, thus making surrogacy a safe and secure process.

Getting Started

Whether you are intended parents or interested in becoming a surrogate or egg donor, the surrogacy process can be one of the most rewarding experiences of your life. Learning more about surrogacy is the first step of your journey.
