You'll work with your dedicated lawyer at Circle to determine parentage in the state in which your surrogate resides.

Surrogacy in New York: parents and surrogate mothers

Parentage is determined in the state in which the surrogate resides and the baby is born. Because of this and New York's outdated surrogacy laws, Circle cannot work with women as surrogate mothers who live in New York at this time.

Circle Surrogacy can, however, work with intended parents who are matched with gestational carriers from surrogacy-friendly states (almost every other state!), including neighboring states of Connecticut, New Jersey and Pennsylvania.
