Gestational surrogacy helps those who cannot have a child on their own become parents. The intended parents (IPs) use a gestational carrier (also referred to as a surrogate mother) to carry a baby to term.

Surrogacy is a process that requires medical and legal professionals to guide the intended parents, as well as a strong support process throughout the journey.

How does surrogacy work?

Through IVF (in vitro fertilization), embryos are created in a lab at a fertility clinic. Sometimes the intended parents use their own genetic material. Sometimes, an egg donor or sperm donor is required. At the fertility clinic, 1-2 embryos are implanted into a gestational carrier, who carries the baby(ies) to term.

What is a surrogate mother?

Surrogates, surrogate mother or gestational carriers are all terms for a woman who carries a baby for someone else. Gestational carriers have no genetic relationship to the children they deliver.

Surrogacy in the United States is a safe way to grow your family if you live in Canada.

The entire surrogacy process will take place in the U.S – creating your embryos at your fertility clinic, the surrogate pregnancy and the birth of your baby(ies).

Intended Parents in Canada will normally travel to the United States to create their embryos (and potentially meet their surrogate) and return for the birth of their babies. When international travel is once again easier, IPs can travel more frequently to the U.S during their journeys.

Once your baby is born, parents from Canada would stay in the U.S until a passport is issued. The amount of time you'll stay in the U.S with your baby depends on many variables, including what documentation you will need to provide to your home country authorities. Once the documentation is process, the U.S passport process usually takes 2 to 3 weeks (though recently it has taken about twice that amount of time).

Why Surrogacy in the U.S is the Safest Choice

1. Your child is a U.S citizen.

Any child born in the United States is a U.S citizen. Your baby will receive a U.S birth certificate and is entitled to a U.S passport for travel purposes (you can usually get one in 24-72 hours from application). Your surrogacy lawyers will do the legal work to establish your parentage (either via a Pre-Birth Order, post-birth order or possibly through a second parent adoption). You will be the sole legal and physical parents under American law. By establishing the rights of parentage in the United States, you can travel home safely and securely.

2. Surrogates are fully screened and receive the best medical care.
In the U.S, gestational carriers are screened psychologically and medically prior to an embryo transfer. Only women who are mentally, physically and emotionally able to handle a surrogacy are accepted into the program. All surrogates reside in the United States and have access to the most advanced medical care and the world's top hospitals. Circle's surrogates have the full support of family and friends during her journey, as well as professional support from a licensed social worker from sign on until postpartum.

3. Financial security.
In the U.S, when you embark on a surrogacy journey with most agencies, your money is safe. Circle is a well-established, secure company. The money you send to the agency is protected, held in a Bonded Escrow Account. These type of accounts are kept only at regulated and approved financial institutions.

 How to Find a Surrogate Mother

How to Find a Surrogate Mother

A question many intended parents have is how do they find a surrogate mother to carry their baby. We recommend working with a surrogacy agency – like Circle Surrogacy – who will manage all aspects of your surrogacy, including finding a surrogate mother match.

We will match you with a surrogate based on 3 criteria:

  • Legal fit (can you legally match with her based on where you and she are located)
  • Views about surrogacy (including your views on selective reduction and termination)
  • Personality fit

It's important that the surrogate mother with whom you match is a good fit for surrogacy. Surrogate mothers must meet strict surrogacy requirements in order to accepted in our surrogate program.

Circle Surrogacy also fully screens their surrogate mothers prior to matching them with intended parents. Surrogates must complete a 3-step screening process in order to meet Circle's standards for matching. Fully screening surrogates before a match is made helps ensure a more successful journey, fewer match breaks and a strong start in your relationship.

Legal Needs for Surrogacy

Circle’s legal team coordinates with local attorneys to ensure that you are properly matched with a surrogate in a state where you can accomplish the necessary legal work to finalize your parental rights.

You will need to have wills finalized prior to the embryo transfer that ensure that a guardian is in place to care for your children in the event of your death.

Once you are matched, we negotiate contracts on your behalf with independent attorneys who represent the egg donor and/or surrogate. Circle works with local attorneys in the states where the surrogates reside in order to accomplish the legal work necessary to secure your parental rights. Depending on a variety of factors, your surrogacy legal work may include a pre-birth order, a voluntary acknowledgement of paternity, a judgment of paternity, a custody orders, or an adoption.

How to Choose a Surrogacy Agency

With so many agencies to choose from, intended parents in Canada should research surrogacy agencies and determine how successful the surrogacy agency is and if it would be a good fit. Choosing your surrogacy is a personal choice, not every agency is suitable for everyone.

How to choose a surrogacy agency in the U.S if you live in Canada

This list of criteria will help intended parents in their surrogacy research of agencies.

  • Agency experience. How many years has the agency been in business? Do they have experience helping international intended parents complete surrogacy and travel home safely?
  • Legal expertise. Does the agency have a legal team on staff who is knowledgeable about surrogacy laws, in particular Assisted Reproductive Technology Law?
  • Success rates. How successful is the agency? Can they share success rates with you when you ask for them?
  • Costs. You will find that costs for surrogacy vary greatly from agency to agency. When interviewing an agency, you should ask for a detailed cost sheet that outlines ALL costs. Compare costs between agencies to ensure that each agency is accounting for all expenses during a journey.   • Views on relationship. Does the agency encourage a relationship between the intended parents and the surrogate? Will the agency develop a strong relationship with you as intended parents during your journey, or will it be more of a business transaction?
  • Personal experience. While it's not imperative that an agency and its team have personal experience with surrogacy, it does help for them to understand first-hand what the surrogacy process is like. (Fun fact: about 44% of Circle's staff has personal experience with surrogacy and third party reproduction as a surrogate or egg donor, or as parents through surrogacy, IVF or adoption!)

Hello! I'm Sarah Marino, Circle's Manager of Client Development and Analysis. I'm here to be a resource and a support person for intended parents (IPs). Getting to play a part in so many IPs' experiences on their road to parenthood is both humbling and an honor.

A little bit about me... after receiving my Master's Degree in International Affairs from Boston University, I worked for Circle Surrogacy for two years as a Program Coordinator, providing intended parents, surrogates and egg donors support throughout their journey. Formerly a Coordinator for the Department of Global Health and Social Medicine at Harvard Medical School, I'm able to draw on my skills and interest for international health and social issues for community outreach and support. Originally from Paris, France, I'm able to use my native language of French to help support and guide French-speaking intended parents during the beginning stages of the surrogacy process.
